Welcome to Rincon Weed Control! By accessing or using our services, including but not limited to our website at rinconweedcontrol.com, scheduling appointments, or receiving services at your property, you agree to be bound by the following Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms These Terms constitute a legally binding agreement between you ("Customer," "You") and Rincon Weed Control ("Company," "We," "Us," or "Our"), a State of Arizona, Department of Agriculture licensed and insured weed control service. If you do not agree to these Terms, you may not use our services.
2. Services Provided Rincon Weed Control provides professional weed control services including, but not limited to, pre-emergent herbicide application, post-emergent herbicide application, and ongoing weed management programs for residential and commercial properties within Rincon Valley, Arizona, and surrounding service areas as defined by the Company.
2.1. Description of Services:

Pre-Emergent Herbicide: Applied to the soil to prevent weed seeds from germinating. This service is preventative and aims to reduce future weed growth.

Post-Emergent Herbicide: Applied to existing, actively growing weeds to eliminate them. This service targets visible weeds.

Subscription Services: Ongoing programs that typically involve multiple applications throughout the year, combining pre-emergent and post-emergent treatments based on seasonal needs and property type.
3. Quotes, Pricing, and Payment
3.1. Custom Quotes: All service quotes are custom and provided based on an assessment of your specific property's size, current weed conditions, and desired service level.
3.2. Transparent Pricing: We strive for transparent pricing. All known charges will be communicated to you in your custom quote.
3.3. Property Condition Disclaimer: Quoted service pricing is based on the assumption of a well-maintained property, free from excessive overgrowth, dense brush, or significant debris that would impede standard treatment application.
* Re-quoting/Cancellation: If, upon arrival, our technicians determine that the property is not in a well-maintained condition (e.g., severe overgrowth, high density of mature weeds, excessive debris impacting access or safety), the original quote may be subject to re-quoting, additional charges, or cancellation of service at Rincon Weed Control's sole discretion. We will endeavor to communicate any such adjustments with you prior to commencing work.
3.4. Payment: Payment for services is due upon completion of the service, unless otherwise agreed upon in writing (e.g., for subscription plans with pre-arranged billing cycles). We accept various payment methods as indicated on our invoices or website.
3.5. Late Payments: Invoices not paid by the due date may be subject to a late fee or interest charge, as specified on the invoice or communicated separately.
4. Scheduling and Access
4.1. Appointments: Services are performed by appointment. We will communicate the scheduled date and approximate time window. While we strive for punctuality, unforeseen circumstances (e.g., weather, equipment issues) may cause delays. We will notify you of any significant changes.
4.2. Property Access: You are responsible for ensuring clear and safe access to the areas of your property where services are to be performed on the scheduled date. This includes, but is not limited to, unlocking gates, securing pets, and removing personal items (e.g., toys, furniture, vehicles) that may obstruct treatment or be inadvertently sprayed.
4.3. Pet and Child Safety: For the safety of your pets and children, we require them to be kept indoors or away from the treatment area during and immediately following applications, as advised by our technicians. You will be informed of specific re-entry times, if applicable.
4.4. Water and Electricity: You agree to provide access to necessary utilities (e.g., water spigot for mixing solutions) if required for the service.
5. Customer Responsibilities

Provide accurate and complete information regarding your property and any specific concerns.

Clearly communicate any areas you wish to be excluded from treatment (e.g., sensitive plants, vegetable gardens).

Follow any pre- and post-service instructions provided by our technicians (e.g., watering instructions, re-entry times).

Notify us promptly of any concerns or issues following a service application.
6. Service Guarantees and Limitations
6.1. Effectiveness: While our goal is complete weed elimination and prevention, various factors outside our control (e.g., weather conditions, extreme weed pressure, germination of dormant seeds, specific weed types) can influence results. We do not guarantee 100% eradication of all weeds nor indefinite prevention. Certain weeds such as Buffelgrass and Bermuda Grass may require specialized treatments and will need to be quoted separately.
6.2. Re-Treatments: For subscription service customers, we offer re-treatments within the scope of your agreement if specific performance issues arise. For one-time services, any re-treatment requests will be assessed on a case-by-case basis and may incur additional charges.
6.3. Damages: Rincon Weed Control exercises reasonable care in the performance of services. We are not responsible for damage to property caused by pre-existing conditions, improper landscaping, non-standard materials, or items not properly secured or removed from the service area prior to treatment. We are not liable for damage to plants or foliage not intended for treatment or due to herbicide drift if not specifically requested by the customer for selective treatment.
7. Cancellation and Rescheduling
7.1. Customer Initiated: You may cancel or reschedule a service appointment by providing at least 24 hours' notice. Cancellations with less than 24 hours' notice may be subject to a cancellation fee.
7.2. Company Initiated: We reserve the right to cancel or reschedule services due to adverse weather conditions, unforeseen operational issues, or if property conditions (as per Section 3.3) are not conducive to safe or effective treatment. We will notify you promptly in such events.
8. Disclaimers
8.1. No Warranties: All services are provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2. Limitation of Liability: In no event shall Rincon Weed Control, its owners, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or the services shall not exceed the amount paid by you for the specific service giving rise to the claim.
9. Indemnification You agree to indemnify, defend, and hold harmless Rincon Weed Control, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your violation of these Terms or your use of our services.
10. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Pima County, Arizona.
11. Changes to Terms We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our website. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
